1. Right to alternative dispute resolution
Under Act No. 391/2015 Coll. on alternative resolution of consumer disputes, a consumer has the right to ask the seller for redress if they are not satisfied with the way the seller handled their complaint, or if they believe the seller has infringed their rights.
A consumer has the right to submit a proposal to initiate alternative dispute resolution (“ADR”) to an ADR entity if the seller responded negatively to the request for redress or did not respond within 30 days of the date it was sent.
2. Alternative dispute resolution entity
The competent entity for the alternative resolution of consumer disputes with the seller is:
A consumer may also turn to another authorised entity listed in the register of ADR entities maintained by the Ministry of Economy of the Slovak Republic (available at mhsr.sk). The consumer is free to choose which of these entities to approach.
3. Submitting a proposal
A consumer may submit a proposal to initiate alternative dispute resolution in writing, electronically or orally for the record. A form available on the website of the relevant ADR entity can be used. The proposal must contain in particular:
- the consumer’s first name, surname and address,
- the exact identification of the seller,
- a description of the decisive facts and of the subject matter of the dispute,
- a statement of what the consumer is seeking,
- the date on which the consumer asked the seller for redress, and information about the outcome.
Alternative dispute resolution is generally free of charge for the consumer. The ADR entity may require the consumer to pay a fee of up to EUR 5 including VAT.
4. Online dispute resolution (ODR)
To submit a proposal for alternative dispute resolution, a consumer may also use the online dispute resolution (ODR) platform, available at:
The ODR platform can be used to resolve disputes between a seller and a consumer arising from a distance contract.
