1. Introductory provisions

These general terms and conditions (the “Terms”) govern the rights and obligations between LEMBERG GROUP s.r.o., as the operator of the restaurants Lev a Láska, Lemberg Bistro and Lemberg Family Bistro (the “operator” or “seller”), and the customer (the “guest” or “buyer”) in the provision of restaurant and hospitality services, the sale of food and drinks, and the acceptance of reservations.

These Terms apply, as appropriate, to consumption on the premises, to the sale of food and drinks to take away, and to orders placed by telephone or electronically, where the operator offers such an option.

2. Scope of services and ordering

The services provided consist of the preparation and serving of food and drinks according to the restaurant’s current offer. The current selection, its composition and prices are set out in the food and drinks menu available on the premises.

3. Prices and payment terms

All prices stated in the food and drinks menu are final and include value added tax (VAT). The price for the services provided is payable after consumption, or on collection of the order.

4. Reservations

A guest may reserve a table by telephone directly with the restaurant concerned — Lev a Láska +421 910 991 110, Lemberg Bistro +421 911 220 126 (both Banská Štiavnica), Lemberg Family Bistro +421 911 700 065 (Zvolen) — or by e-mail. A reservation is binding once confirmed by the operator.

5. Complaints and quality

The operator is responsible for ensuring that the food and drinks served correspond to the order and meet quality and hygiene requirements under applicable law.

7. Withdrawal from the contract

Under Act No. 102/2014 Coll. on consumer protection in the sale of goods or provision of services under a distance contract, the right of withdrawal does not apply to contracts for the provision of catering services at an agreed time of performance, nor to the sale of goods subject to rapid deterioration (prepared food and drinks).

8. Alternative dispute resolution

A consumer has the right to ask the seller for redress if they are not satisfied with the way a complaint was handled or believe that the seller has infringed their rights. If the seller responds negatively or does not respond within 30 days, the consumer has the right to submit a proposal to initiate alternative dispute resolution. 9. Protection of personal data

The operator processes guests’ personal data in accordance with applicable law. Further information is set out in the Privacy Policy (GDPR).

10. Final provisions

These Terms take effect on the date of their publication. The operator reserves the right to amend or supplement the Terms at any time; the amended terms take effect on the date of their publication on the website. Legal relationships not governed by these Terms are subject to the relevant provisions of the law of the Slovak Republic, in particular the Civil Code and the Consumer Protection Act.
